This Privacy Policy applies to personal information that Delbarton School (“DELBARTON”) may collect and use depending on how you choose to interact with websites which are owned or operated by DELBARTON, including without limitation www.delbarton.org, as well as any other website owned or operated by DELBARTON currently or in the future and any and all website-related services and platforms (collectively, the “Website”).
DELBARTON is an independent Roman Catholic college preparatory school for young men in grades 7 through 12, located in Morristown, New Jersey. DELBARTON is committed to protecting the privacy of all individuals who interact with our school, whether through our Website, our admissions and enrollment processes, our summer programs, our advancement and fundraising activities, or other school-related functions. The purpose of this Privacy Policy is to enable you to determine the manner in which your information is collected, used, stored, and disclosed by DELBARTON.
Please also refer to the Mandatory Terms of Use , which are expressly incorporated herein by reference. Unless otherwise defined herein, all terms have the meanings they are assigned in the Mandatory Terms of Use.
This Privacy Policy applies to all individuals who visit our Website, submit inquiries or applications, make donations, attend events, or otherwise provide personal information to DELBARTON. This policy applies regardless of how you interact with us, whether online, by phone, by mail, or in person.
By using our Website or providing personal information to DELBARTON, you acknowledge that your information will be handled as described in this Privacy Policy.
2. Types of Personal Information Collected
With the exception of data collected automatically on DELBARTON websites regarding network activity of website visitors, cookies and other technologies, DELBARTON does not collect any other personal information unless you provide such information to DELBARTON. Generally, the functionality of the Website, excluding the Restricted Platforms (defined below), is such that it may be accessed and browsed for informational purposes without providing any information to DELBARTON. DELBARTON may collect the following categories of personal information depending on the nature of your interaction with us:
Contact and Identification Information. This may include names, mailing addresses, email addresses, telephone numbers, dates of birth, financial information, and similar identifiers provided by prospective families, current families, alumni, donors, and other community members. For example, DELBARTON may collect personal information when you choose to utilize certain features on the Website, including, without limitation, accessing links found under the “Contact Us” tab, communicating with us by phone or e-mail, engaging in the registration process to create a personal user profile on the Alumni Portal, logging into WaveNet or other Restricted Platforms, making a donation to DELBARTON via the Online Fund, or submitting an application for admission to DELBARTON online.
Admissions and Enrollment Data. When families inquire about or apply to DELBARTON, we may collect student names, parent or guardian names, entry grade, academic transcripts, standardized test results, teacher recommendations, interview notes, and financial aid application materials (including income and household financial information submitted through third-party services such as Clarity).
Advancement and Donor Data. DELBARTON may collect information related to charitable giving, including donor names, contact information, gift amounts, employer matching gift information, payment details, and correspondence related to fundraising campaigns.
Website Usage Data. When you visit the Website, we may automatically collect certain technical information through analytics tools such as Google Analytics, Cloudflare Web Analytics and Adobe Fonts. This may include your IP address, browser type, operating system, device type, pages viewed, time spent on pages, referring URLs, and approximate geographic location (such as country, state, or city).
Event Registration and Program Information. If you register for DELBARTON events, summer programs, or athletic camps, we may collect participant names, ages, grade levels, emergency contact information, health or medical information relevant to participation, and payment information.
Communications Data. If you contact DELBARTON by email, phone, or through website inquiry forms, we may retain records of those communications, including their contents and any attachments and any personal information conveyed therein.
Alumni Data. DELBARTON maintains records of its alumni network, which may include educational history, professional information, contact details, and giving history.
Restricted Platform Data. Access to certain portions of the Website, including without limitation the WaveNet platform, is restricted to current and former students, faculty, and staff of DELBARTON (the “Restricted Platforms”) solely for the benefit of these individuals and the DELBARTON community and not for any commercial purpose or non-personal purpose. Access to the Restricted Platforms is conditioned upon a user entering a DELBARTON-issued username and determining a password. The Restricted Platforms are internally hosted by DELBARTON, and the username and password provided to gain access thereto are used by DELBARTON solely to authenticate the user for internal operating purposes. Username and password information is not disclosed or otherwise made accessible to any third party entity, nor made publicly available. Parents or guardians of users under 13 are encouraged to monitor their child’s use of the Restricted Platforms and any material posted thereon. Should the parent or guardian of an individual accessing the Restricted Platform seek to prohibit further access from same, he or she may contact DELBARTON.
3. Purposes for Data Collection and Processing
DELBARTON collects and processes personal information for purposes related to our educational mission and the operation of the school, including:
Admissions and Enrollment. We process applicant and family information to evaluate candidates for admission, communicate with prospective families, administer entrance examinations, conduct interviews, and manage the enrollment process.
Educational Programs and Student Services. We use student and family data to deliver educational services, manage academic records, coordinate athletics and extracurricular activities, and support student well-being.
Advancement and Fundraising. We process donor and alumni information to solicit and acknowledge charitable gifts, administer matching gift programs, maintain donor records, and communicate with our alumni community about school news and events.
Website Operations and Improvement. We may use website analytics data to understand how visitors use our Website, to improve Website content and functionality, and to monitor Website performance.
Communications. We may process personal information to respond to inquiries, send school communications and newsletter, and share information about programs and events. You agree that DELBARTON may contact you by phone, fax, mail or electronic means. You may opt out of such communications at any time.
Financial Aid Administration. We process financial information submitted by families to determine eligibility for need-based financial aid awards.
Legal Compliance and Safety. We may process personal information as necessary to comply with applicable laws, protect the safety and security of our community, establish or defend legal claims, and enforce our policies.
4. Disclosure to Processors and Sharing Data to Third Parties
DELBARTON does not sell personal data for money. We may share personal information with processors or third parties in the following circumstances:
Processors. We engage vendors and service providers who perform functions on our behalf, known as processors, such as website hosting, enrollment management platforms, financial aid assessment services, payment processors, analytics providers, and email communication platforms. These providers are given access to personal data only as necessary to perform their services and are prohibited from using such information for other purposes.
Online Fund and Donation Processing. When you make a financial contribution to DELBARTON via the Online Fund, the credit card and any other financial information provided by you is used solely for the purpose of immediately processing your donation. Online contributions to DELBARTON are processed by Blackbaud, a third-party service provider, whose terms regarding use, storage and disclosure you should familiarize yourself with prior to making a donation. DELBARTON does not retain a copy of your credit card information.
Educational and Regulatory Bodies. We may share student information with educational associations, accrediting bodies, or government agencies as required by law or as necessary to fulfill our educational mission.
Donor Recognition. With donor consent, DELBARTON may publicly recognize charitable contributions in school publications or on campus. Donors may opt out of public recognition at any time.
Legal Requirements. We may disclose personal data when required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect the rights, property, or safety of DELBARTON, our students, or others. Additionally, any such information may be transferred to a third party in the event of a sale, acquisition, merger or bankruptcy involving DELBARTON or any parent, subsidiary or section thereof.
Professional Advisors. We may share personal data with our attorneys, accountants, insurers, and other professional advisors as needed.
Third Parties. We may share personal information with our third-party analytics and advertising vendors, such as Google and Cloudflare for the purposes of delivering relevant advertisements to you and analyzing how our websites are performing.
If you do not wish for DELBARTON to disclose your information in accordance with this policy, please do not submit any personal information to DELBARTON. If you believe special circumstances warrant special treatment of your personal information, please contact us.
5. Data Retention
DELBARTON retains personal data only for as long as necessary to fulfill the purposes for which it was collected or as required by law. The criteria used to determine retention periods include:
Enrollment and Academic Records. Student academic records are retained permanently as part of our institutional archive, consistent with standard practices for educational institutions. However, credit card information you provide in connection with your use of the Online Fund is not stored by DELBARTON.
Admissions Records. Records of applicants who do not enroll are generally retained for a limited period following the admissions cycle and then securely disposed of.
Financial and Donor Records. Financial transaction records and donor giving histories are retained to be in compliance with applicable tax and accounting requirements.
Website Analytics Data. Aggregated and anonymized website usage data may be retained indefinitely for trend analysis. Individual-level analytics data is retained in accordance with the retention settings configured in our analytics tools.
Communications. Records of communications are retained for a reasonable period based on the nature of the correspondence and any applicable legal requirements.
When personal data is no longer needed for the purposes described above, DELBARTON will securely delete or anonymize the information.
6. User Rights
DELBARTON respects the rights of individuals with regard to their personal information. Depending on the nature of your relationship with us and applicable circumstances, you may have the right to:
Access. Request confirmation of whether DELBARTON holds personal data about you and, if so, request a copy of that data.
Correction. Request that inaccurate or incomplete personal data be corrected or updated.
Deletion. Request that your personal data be deleted where it is no longer necessary for the purposes for which it was collected, subject to our legal obligations and legitimate interests in retaining certain records (such as academic transcripts or tax-related donor records).
Objection. Object to certain processing of your personal data, including processing for direct marketing purposes. If you wish to unsubscribe from DELBARTON communications, you may do so by following the unsubscribe instructions in any email or by contacting us directly.
Data Portability. Request that personal data you have provided to us be delivered in a structured, commonly used format.
Withdrawal of Consent. Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing that occurred before the withdrawal.
To exercise any of these rights, please contact DELBARTON using the information provided in Section 13 below. DELBARTON will respond to requests within forty-five (45) days and may ask for verification of your identity before fulfilling a request. If reasonably necessary, DELBARTON may extend its time to respond by an additional forty-five (45) days, and will notify you of the extension and the reason for the delay within the initial forty-five (45) day period.

7. Security Measures
DELBARTON takes the security of personal data seriously and implements reasonable technical and organizational measures designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These measures include:
Technical Safeguards. We use encryption, firewalls, secure server environments, and access controls to protect data stored and transmitted electronically.
Organizational Safeguards. Access to personal data is limited to authorized personnel who need the information to perform their duties. Staff with access to sensitive data receive training on data protection practices.

Although DELBARTON is a 501(c)(3) Charitable Non-Profit Organization exempt from the requirements of the Federal Children’s Online Privacy Protection Act of 1998 (COPPA), DELBARTON is committed to the protection of the online privacy of individuals under the age of 13 as well as parental control over information collected from children online. DELBARTON does not collect personal information directly from children under 13 online. For children under 13, any information provided to DELBARTON on such child’s behalf must be provided by their parent or legal guardian.
For visitors known to be between the ages of 13 and 17, we do not process personal data for purposes of targeted advertising, sell personal data, or engage in profiling that produces legal or similarly significant effects with respect to them without first obtaining that visitor's consent.

Parents or guardians of users under 13 are encouraged to monitor their child’s use of the Restricted Platforms and any material posted thereon. Should the parent or guardian of an individual accessing the Restricted Platform seek to prohibit further access from same, he or she should not hesitate to contact DELBARTON.
The Website also provides a platform that enables certain users, other than children, to make a financial contribution to DELBARTON online (the “Online Fund”). DELBARTON does not permit children to make contributions using the Online Fund and therefore does not collect or use the personal information of children in its operation of the Online Fund.
The personal information of children is collected by DELBARTON if an application for admission to DELBARTON is submitted online. Such applications may only be submitted by the parents or guardians of children or their designees, such as guidance counselors or admissions advisors with parental consent, and the information provided therein is used solely for the purpose of considering the candidate for admission to DELBARTON.
Parents or guardians who are concerned about information possibly submitted to DELBARTON by their children should contact webmaster@delbarton.org and someone will promptly assist in the removal of such data.
10. Territoriality
Our computer systems are based in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world.
BY USING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND THAT THE COLLECTION, PROCESSING, AND STORAGE OF PERSONAL INFORMATION BY DELBARTON OCCURS WITHIN THE UNITED STATES , AND AGREE THAT UNITED STATES LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING.
11. Update And Opt-Out
If you would like to update any information you have sent to DELBARTON, or if you do not want to receive information from DELBARTON, please contact us at webmaster@delbarton.org.
DELBARTON will also take reasonable efforts to honor any request you make to forgo contacts with you in the future or delete your information. Please note that if you make an opt-out request, DELBARTON will retain your contact information to make efforts to ensure that you are not contacted in the future. Additionally, if you request DELBARTON to refrain from sharing your information with third parties, DELBARTON may be unable to fulfill various requests you may make.
By sharing with us your fax and email information, you consent to our delivery of faxes and emails to you from time to time.
To the extent required by the CAN-SPAM Act, or other similar domestic and international regulation, commercial e-mail messages will also provide you with an opportunity to opt-out of receiving this information. Please note that changes to your preferences may not be effective immediately.

14. New Jersey Consumer Privacy Rights
If you are a New Jersey resident, you have the following rights under the New Jersey Data Privacy Act (NJDPA), N.J. Stat. § 56:8-166.4 et seq., effective January 15, 2025:
1. Right to Confirm and Access. You have the right to confirm whether DELBARTON processes your personal data and to access the personal data we hold about you.
2. Right to Correct. You have the right to request correction of inaccurate personal data.
3. Right to Delete. You have the right to request deletion of your personal data, subject to certain exceptions (such as legal obligations to retain records, academic transcripts, or tax-related donor records).
4. Right to Data Portability. You have the right to obtain a copy of personal data you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
5. Right to Opt Out. You have the right to opt out of: (i) the sale of your personal data; (ii) targeted advertising based on your personal data; and (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. Please note that DELBARTON does not sell personal data for monetary consideration and does not use personal data for profiling that produces legal or similarly significant effects.
Universal Opt-Out Mechanism. DELBARTON will honor Global Privacy Control (GPC) signals and other user-enabled universal opt-out mechanisms recognized under New Jersey law as valid requests to opt out of any applicable processing activities. We will process and implement direct consumer opt-out requests (for targeted advertising, data sales, or profiling) within 15 days of receiving them.
Exercising Your Rights. We will respond to your request within forty-five (45) days of receipt. If we require additional time (up to a forty-five (45) day extension, where reasonably necessary), we will notify you of the extension and the reason for it. You may designate an authorized agent to submit a request on your behalf, provided the agent can demonstrate proper authorization.
Verification. Before fulfilling your request, we may need to verify your identity. We will ask you to provide information that allows us to reasonably verify you are the person about whom we collected personal data or an authorized representative of that person.
Appeal Process. If we decline to take action on your request, you have the right to appeal that decision. To submit an appeal, please email webmaster@delbarton.org with the subject line “Privacy Rights Appeal” and include your original request and the reason for your appeal. We will respond to your appeal within forty-five (45) days of receipt. If we deny your appeal, we will provide you with instructions on how to submit a complaint to the New Jersey Division of Consumer Affairs. If we require additional time, we will notify you of the extension and the reason for it.
Non-Discrimination. DELBARTON will not discriminate against you for exercising any of your privacy rights under the NJDPA. We will not deny goods or services, charge different prices, or provide a different level or quality of services because you exercised your rights.
Sensitive Data. The NJDPA defines certain categories of personal data as “sensitive data,” including data revealing racial or ethnic origin, religious beliefs, mental or physical health conditions, sexual orientation, citizenship or immigration status, genetic or biometric data, precise geolocation data, personal data of known children, and certain financial information. DELBARTON will obtain your consent before processing sensitive data, unless an exemption applies under applicable law.

MOBILE MESSAGING TERMS AND CONDITIONS

Delbarton School (“DELBARTON”, “we”, or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (the “Mobile Messaging Terms”). The Program and our collection and use of your personal information are also subject to our Privacy Policy. By enrolling in, signing up, or otherwise agreeing to participate in the Program, you accept and agree to be bound by these Mobile Messaging Terms and our Privacy Policy.
1. Program Description.
The Program is designed to provide members of the DELBARTON community, including parents, guardians, alumni, students, faculty, and staff, with: (i) information regarding your account; (ii) school announcements, events, and programs; (iii) emergency or safety-related notifications; and (iv) athletics and extracurricular activity updates via SMS and MMS text messaging. Mobile messages may be sent using automated technology, including automated system or automatic telephone dialing system (autodialer). Message frequency will vary depending on school events and activities, but will not exceed 10 messages per month under normal circumstances. Emergency or safety-related messages are not subject to this frequency cap. Text messages will only be sent between the hours of 8:00 a.m. and 9:00 p.m. in your local time zone, except for emergency or safety-related notifications.
You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics, and that such messages and/or calls may be sent from different telephone numbers or short codes. We do not charge fees for mobile messages sent through the Program; however, you are responsible for any message and data rates imposed by your mobile provider. Standard data and messaging rates may apply.
2. User Opt-In and Consent.
By providing your mobile phone number to us, you are voluntarily opting in to the Program and you agree to receive recurring automated mobile messages from us at the mobile phone number associated with your opt-in. Your consent is not a condition of enrollment at DELBARTON or of receiving any other services from DELBARTON. Participation in the Program is entirely voluntary.
You represent and warrant that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user, and that you are authorized to consent to receiving text messages at that number. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number you provided, you agree to promptly notify DELBARTON at 973-538-3231 x3051 or by emailing webmaster@delbarton.org.
You acknowledge that by opting in, you consent to receive automated messages even if your number is registered on any state or federal Do Not Call list, to the extent such consent is required and permitted by applicable law, including the Telephone Consumer Protection Act, 47 U.S.C. § 227, and its implementing regulations.
3. User Opt-Out and Support.
You may opt-out of the Program at any time. To stop receiving mobile messages from DELBARTON, reply STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any mobile message you receive from us. We will honor your opt-out request within ten (10) business days. If we require additional time, we will notify you of the extension and the reason for it. You may continue to receive text messages for a short period while we process your request and you may receive a one-time opt-out confirmation message.

Please note that our mobile messaging platform may not recognize opt-out or support requests that modify or deviate from the standard keywords listed above, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. If you experience difficulty opting out using the methods described, please contact us directly at the telephone number or email address provided above, and we will process your request manually.
DELBARTON may change the telephone number or short code used to operate the Program. If such a change occurs, we will make reasonable efforts to notify you. Opt-out requests sent to a telephone number or short code that is no longer in use may not be received, and DELBARTON cannot be responsible for honoring requests directed to a deactivated number.
4. Privacy and Data Use.
DELBARTON collects and uses your mobile phone number and related information solely for the purpose of operating the Program and communicating with you as described in these Mobile Messaging Terms. We will not sell, rent, or share your mobile phone number or opt-in information with unaffiliated third parties for their own marketing purposes.
Your personal information may be shared with third-party service providers who assist DELBARTON in operating the Program (e.g., messaging platform vendors), but only to the extent necessary to deliver messages and administer the Program, and subject to appropriate confidentiality obligations.

5. Disclaimer of Warranty and Liability.
The Program is offered on an “as-is” and “as-available” basis. DELBARTON does not guarantee that the Program will be available in all areas, at all times, or on all mobile carriers or devices. Message delivery is subject to the effective transmission by your mobile carrier and other factors outside DELBARTON’s control.
To the fullest extent permitted by applicable law, DELBARTON and its service providers shall not be liable for any failed, delayed, or misdirected delivery of any mobile message or for any errors in message content, except to the extent caused by DELBARTON’s willful misconduct or gross negligence. Nothing in these Mobile Messaging Terms is intended to limit DELBARTON’s liability for personal injury or other claims that cannot be limited by law.
6. Modifications.
DELBARTON reserves the right to modify, suspend, or discontinue the Program or any of its features at any time, with or without prior notice. We may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when the revised Mobile Messaging Terms are posted to our website at https://www.delbarton.org/legal. We encourage you to review these Mobile Messaging Terms. Your continued participation in the Program after any modification constitutes your acceptance of those modifications. If you do not agree to a modification, you may opt out of the Program at any time using the procedures described in Section 3 above.
7. Contact Information.
